Bill of Rights Day – December 15th
The United States of America might never have existed without one thing: the Bill of Rights. The Bill of Rights limits the power of the government and protects the rights of the people. It was so important that several of the original 13 states would not ratify the Constitution without it.
Nearly everything that makes us proud to be an American comes from the Bill of Rights: it guarantees the freedoms to speak, print, read, assemble, pray, petition the government, and to keep and bear arms. It protects us from unreasonable arrests and searches, excessive bail, double jeopardy, coerced confessions, and from cruel and unusual punishment. It upholds our rights to due process, jury trials, counsel, and to present defense witnesses. These are the freedoms and rights that define America.
Surprisingly, Americans do not celebrate the foundation of our political freedom, the Bill of Rights -- but we should. After all, the Bill of Rights is part of our Constitution, the highest law of the land. It is uniquely American. People on the political left, center, and right can all rally around the Bill of Rights because it expresses our shared basic values.
Sadly, the Bill of Rights and the Constitution as a whole is under attack by those very people who have sworn to uphold it -- our elected officials. From every corner of the political spectrum we have those who say it is a “living document” and must be “interpreted” in the light of modern political thought. They would have us believe that certain parts of the Bill of Rights don’t apply any more or are “outdated”. They would like to treat it as a smorgasbord where they get to pick and choose only the parts they like or agree with. This is dangerous thought. The Bill of Rights must be treated as a whole where every amendment stands shoulder to shoulder with every other and where the original meaning set down in ink by our Founders is respected and upheld. Yes, times do change, and the Constitution includes a mechanism to amend it as the need arises, but this is the only proper way to alter the content of this most important document.
On December 15, 1791, the Bill of Rights was ratified and has since protected American citizens for 214 years. We should celebrate December 15th every year. By officially designating it as Bill of Rights Day, we would be reminding our fellow citizens and younger generations of our heritage, our freedoms, and our liberties. Bill of Rights Day would declare America's commitment to individual human rights. The special day would remind politicians, bureaucrats, prosecutors, and judges that their authority and power are limited -- that the government derives its power from the people -- it does not rule us as subjects.
December 15, Bill of Rights Day, reminds us of the liberty we have and what it costs to keep it. By celebrating Bill of Rights Day every year, perhaps we shall never forget.
